This Privacy Statement is issued by Roscommon County Council Áras on Chontae, Roscommon, Co. Roscommon, F42 VR98 (“RCC, “we”, “us”, “our”). It applies to the N61Roscommon.ie website and governs data collection and usage for the N61 Ballymurray to Knockcroghery Road Project.

The N61 Ballymurray to Knockcroghery Road Project involves a study of a section of the N61 between Ballymurray and Knockcroghery (St. Johns) in order to identify a transport solution to cater for travel demand in the area. The project is being undertaken by Roscommon National Regional Roads Office on behalf of Roscommon County Council with the support of Transport Infrastructure Ireland. Roughan & O’ Donovan – Aecom Alliance have been appointed as Lead Technical Consultants to advance the project through the planning, design and statutory phases.

Purpose of Privacy Statement

The purpose of this privacy statement is to describe, in clear and concise terms, the personal data that Roscommon County Council may collect about individuals in connection with the N61 Ballymurray to Knockcroghery Road Project, why it is needed, how it is used and how individuals may interact with Roscommon County Council in relation to their personal data.  It also outlines the rights of individuals under data protection legislation in relation to the processing of their personal data.

Personal Data that we Collect and Process

We will collect and process personal data relating to you that you or other people provide to us in connection with the Project. We will also collect and process personal data relating to you from publicly available sources such as the Land Registry and the Registry of Deeds.

This personal data may include:

  • your name and contact details, including your address, Eircode, phone number and email address
  • your interest in any land and/or rights proposed that may have to be acquired, public and private rights of way proposed to be acquired/extinguished and planning   permissions   for   the  development of land proposed to be revoked or modified (the “Property”) (e.g. owner, reputed owner, occupier, reputed occupier etc.)
  • any other personal data relating to you that you provide to us or that we generate about you in connection with the Project

Purposes of Processing and Legal Basis

We will use personal data relating to you for the purposes of:

  • creating a database of property owners, tenancies, property details and correspondence with owners and/or tenants
  • developing of the project through the planning, design phases and construction phases
  • corresponding with you in relation the Property
  • where applicable, calculating and making payments in respect of the Property
  • establishing, exercising or defending legal claims
  • performing our functions as a public authority and complying with our legal obligations.

The legal bases on which we process your personal data are:

  • that this is necessary for the performance of our functions that we carry out in the public interest and the exercise of official authority vested in us by law, including the Roads Act 1993, as amended, and the Planning and Development Act 2000, as amended
  • that this is necessary for compliance with a legal obligation that applies to us
  • in circumstances where a Property will be effected by a contract, for the performance of our contract with you

Use of your Personal Information

We may where applicable disclose your personal data to other organisations in connection with the above purposes, including:

  • statutory agencies, where required or permitted by law as part of the statutory planning process
  • outsourced property referencing providers
  • other third parties who we engage to provide services to us, such as outsourced service providers, IT services providers, professional advisers, contractors and auditors
  • other public authorities and bodies where required or permitted by law, such as An Garda Síochána, for the purposes of the prevention, investigation, or detection of crime
  • members of the public where we are required to make information publicly available under applicable law

Any organisation or third party to which we may disclose your personal data with are prohibited from using your personal information except to provide services to Roscommon County Council and they are required to maintain the confidentiality of your information. The exception to this is the disclosure of your personal data to other public authorities and bodies where required or permitted by law.

Disclosure of your Personal Information

Retention

We will not hold your personal data for longer than is necessary. Requirement to Provide Data

You are not under a statutory obligation to provide us with personal data in relation to the development of the project. However, there are some pieces of information that you must provide to us so that we can comply with our obligations for your benefit in connection with the development of the project, such as your name, contact details and details of your interest in a Property.

Your rights

You have the following rights, in certain circumstances and subject to certain restrictions, in relation to your personal data:

  • the right to access your personal data
  • the right to request the rectification and/or erasure of your personal data (erasure is not available where an appeal has been determined) the right to restrict the use of your personal data
  • the right to object to the processing of your personal data
  • where our processing is based on contract, the right to request us to provide you, or a third party, with a copy of your personal data in a structured, commonly used machine-readable format
